Job Description

The New York City Loft Board oversees the conversion of Interim Multiple Dwelling (IMD) buildings to safe residences and compels landlords to bring these spaces up to the minimum standards of the New York City Building Code or Article 7B of the Multiple Dwelling Law.

Loft Board attorneys conduct conferences, mediate disputes between owners and tenants, review applications and plans, prepare notices of proceedings and supporting documents to the Office of Administrative Trials and Hearings for fact finding hearings, issue Loft Board certifications and letters of no objection, draft recommended orders to the Loft Board disposing of cases and handle other projects as needed.

The Assistant General Counsel, Agency Attorney L3 will report to the Deputy Director and, with wide latitude for independent judgment and unreviewed action and decision, will perform complex legal work to include the following:

Prosecute violations of the Housing Maintenance Standards at the NYC Office of Administrative Trials and Hearings
Prosecute enforcement actions for violations of 2-01.1 of Title 29 of the Rules of the City of New York at the NYC Office of Administrative Trials and Hearings
Drafting motions and responsive papers in cases in enforcement cases
Drafting settlements in actions initiated by the Loft Board
Handling complex legal assignments and issues including:
o Drafting proposed orders in complex master calendar cases
o Recommending statutory and regulatory revisions to the Multiple Dwelling Law and Title 29 of the Rules of the City of New York
o Drafting proposed legislation and regulatory amendments
o Conferring with subject matter specialists, technical experts and other attorneys including counsel for litigants.
Conduct conferences with owners and tenants for narrative statement filings Draft administrative determinations in legalization disputes
Prepare reports for the Board about enforcement and legalization efforts
Provide direction to attorneys and paralegals
Supervise staff as assigned
Legal research

Minimum Qualifications

1. Admission to the New York State Bar; and either "2" or "3" below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

- Ability to read architectural drawings - Ability to handle multiple tasks - Excellent organizational and written communication skills - Computer literacy, including the use of Microsoft applications - Familiarity with NYC landlord/tenant law, administrative law, the NYC Construction Codes and the NYC Zoning Resolution - Mediation experience preferred - Experience in drafting complex rules
